New FL State Law Regarding CBD Products

• New laws went into effect on 01.02.2020

• 1. A scannable quick response (QR) code linked to the certificate of analysis of the Hemp Extract by an independent testing laboratory.
  2. The batch number (lot number)
  3. The internet address of a website where batch information may be obtained
  4. The expiration date
  5. The number of milligrams of Hemp Extract per package. If specific cannabinoids are marketed, the milligrams per serving of the specific cannabinoid must be listed and the serving size shall be displayed on the nutrition facts or supplement facts label of the product
  6. The statement: “Product contains a total delta-9 tetrahydrocannabinol concentration that does not exceed 0.3% on a dry-weight basis.” (note: statement cannot be modified)

• Each batch of tea made must be tested by our third-party CBD lab. A batch refers to a lot which means:
  • Every tea must be tested. If the order is for 4 teas with CBD each of the 4 teas must be tested
  • Every time the product is order it must be tested. If you order today and tomorrow you order the same tea the tea would be tested twice since it is made in 2 different lots
  • The cost is $300 per tea per testing package. This covers:
    • Lab testing fees (CBD content, CBD label claim, micros, pesticides, heavy metals), preparing of the sample, cost of materials for sample, shipping of sample to the lab, hosting of COA, creation of QR code, updating current label with latest QR code and physical web address to new COA.

  • Must use an FL testing lab to test to FL State standards. Lab in other states does not test to FL State standards.
• Process
  • Order placed and paid for
  • Product made and infused with CBD
    • Note: this may take the extra time in a custom blend
  • Need to wait 2-3 days for CBD to cure and fully dry
  • Sample sent off to the lab
  • Testing completed
    • Lead time is 5-10 working days
  • Assuming there are no issues with the testing:
    • Update label with new QR code and web address
    • Print labels
    • Start production
    • Ship product
  • If there is an issue with the CBD claim:
    • Rework the blend adding CBD as needed
    • Wait for the CBD to cure and dry
    • Send out for the second test (requires an additional fee)
    • Update label with new QR code and web address
    • Print labels
    • Start production
    • Ship products
